What's In Online Community Code of Conduct and Terms of Use (the "Code of Conduct")

TJ Maxx has established the What's In Online Community Site ("What's In") to allow people to share ideas about fashion and merchandise. At What's In, people can post comments and photographs to a community site and send email message alerts via computer or wireless devices to other people who have registered to receive such messages. You must register to participate in What's In. For the protection of all registered members of What's In, T.J. Maxx and its parent, The TJX Companies, Inc. (together with T.J. Maxx, collectively referred to herein as "TJX" or "we" or "us"), reserve the right to review member profiles, comments, photographs, notes, text, information and any other material or content submitted or posted to What's In (collectively, "Content"), and to edit or delete, in whole or in part, any Content submitted or posted to What's In (including, without limitation, the right remove profiles of registered members) that violates this Code of Conduct or for any other reason. TJX may, but is not obligated to, use the information you provide to TJX to contact you so that you may revise your submission. In TJX's sole discretion, anyone may be prohibited from participation in What's In for any or no reason. You acknowledge and agree that TJX may store any Content or other information that you submit or post. You acknowledge and agree that TJX is not liable for any lost or intentionally deleted Content or other information.

The views and opinions expressed in What's In should not at any time be considered as representative of the views of TJX or any of its subsidiaries or affiliates. We do not verify the accuracy of any merchandise availability, prices or "compare at" prices that appear in any Content submitted by users (including, without limitation, prices posted in "Fashion Moments"). You are and will remain personally and solely responsible for the Content that you submit or post to What's In and all actions arising therefrom.

By registering as a member of What's In, you acknowledge that you have read and agree to this Code of Conduct and that you are granting to TJX a non-exclusive, perpetual, worldwide license to distribute, reproduce, republish and publicly display your Content, in TJX's sole discretion, in What's In (including, without limitation, in message alerts sent to other registered users) and in any other media, and to use any ideas, concepts, know-how, or techniques contained in your Content for any purpose whatsoever, including, without limitation, developing, manufacturing, and marketing products using such Content, without any further consent from or notice or compensation to you.

  1. Be Honest. Be who you are. Do not misrepresent or impersonate any person or entity or misrepresent your age or your affiliation with any person or entity. Do not register for more than one profile or use or attempt to use someone else's profile as your own.
  2. Stay Focused. Do post or submit comments, photographs and alerts that stay close to the stated focus of What's In. Do not post or submit comments, photographs or alerts that contain off-topic content such as political or religious statements. Do not flood or spam, or post chain letters, pyramid schemes, junk mail, etc.
  3. Use Common Sense. Do not post or include in any comment, photograph or alert any confidential or personal information that you do not want to share with strangers on the Internet, including telephone numbers, addresses and electronic signatures. Please keep in mind that other users may claim expertise or status (legal, medical, etc.) that they do not, in fact, possess. Do use discretion in following their advice. You agree and accept liability associated with the use of any content, including but not limited to your reliance on the accuracy, completeness, or usefulness of such content. In this regard, you acknowledge and agree that you may not rely on any content created by TJX or submitted to TJX, including without limitation information in What's In.
  4. Respect Personal Information. Do not post or include in an alert any confidential or personal information of any third party, including telephone numbers, addresses or email addresses. Do not solicit personal information from anyone. Do not harvest or collect email addresses or other contact information of other users from What's In by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications.
  5. Be Appropriate. Refrain from posting or including in an alert any material that is obscene, pornographic, defamatory, profane, libelous, threatening, intimidating, discriminatory, harassing, offensive, abusive, hateful, embarrassing or disparaging to another person, group of persons or entity or that violates the privacy rights of others. Do not bully. Do not depict graphic or gratuitous violence. Do not engage in any predatory or stalking conduct.
  6. Advertisements and Solicitations. At What's In, we're eager to hear about what inspires you, our customers, and we encourage you to share your experiences with our stores and with other fashion resources. However, we ask that you not post or include in an alert any overt promotional information or advertisements strictly for the purposes of self-promotion.
  7. Respect Copyrights. Do not post or include in an alert any material unless (i) you own or have all of the rights necessary to post or distribute such material and (ii) the posting or distribution of such material does not violate the privacy rights, publicity rights, copyright or any other rights of any person. Respect all laws governing copyright, trademark, and other intellectual property rights, including TJX's own intellectual property. If you wish to reference third party content, do not copy the content without permission. Where appropriate, please provide a hyperlink to any referenced online content.
  8. Discuss What You Know. Do not make specific, non-verifiable, non-firsthand claims about people or companies.
  9. Protect Your Password and Account. Do protect the security of your password and other account information and do not share it with anyone else. You are fully responsible for all activites that occur under your password or account. You agree to (a) immediately notify TJX of any unauthorized use of your password or account or any other breach of security; and (b) ensure that you exit from your account at the end of each session. You acknowledge and agree that TJX is not liable for any loss or damage arising from your failure to comply with this Code of Conduct. Do not use or attempt to use another's account without authorization from TJX, or create a false identity on What's In.
  10. Comply with Law. Do not engage in or promote any illegal activity through What's In or post or include in an alert any material that fails to conform with all applicable federal, state, local and international laws.
  11. Respect Others. Do not attack personally fellow What's In users, affiliates, partners, customers, consumers or shareholders. When you disagree with a posting, do so with respect and without resorting to personal attacks. While referencing our competitors is accepted and welcome as open dialogue, do not attack companies that are competitors of TJX.
  12. Use Resources Wisely. Do not post or include in an alert any material that contains viruses, Trojan horses, worms, spyware or other computer code that is intended to damage, interfere with or surreptitiously intercept or expropriate any system or information.
  13. Mobile Services. What's In includes certain services that are available via your mobile phone, including the ability to send alerts to other users and receive alerts submitted by other users. We do not charge for these mobile services. However, your carrier's normal messaging, data and other rates and fees will still apply. You may Opt-out at anytime by sending the word STOP. Help is also available by sending the word HELP. The following US carriers are supported: Alltel, AT&T, Boost Mobile, Cellular One, Cellular South, Cincinnati Bell, Nextel, Sprint, T-Mobile, US Cellular, Verizon Wireless, Virgin Mobile. You will be able to send up to 25 alert messages per month via your mobile phone.
  14. Contact Us. The focus of What's In is fashion and merchandise. If you have another issue you would like to communicate to TJX, please contact us by clicking on Contact Us. In addition, if you believe that any material posted on What's In or sent in an alert violates any provision of this Code of Conduct, or if you otherwise observe any violations of this Code of Conduct, please let us know by clicking the "Report Abuse" link associated with the relevant material. If you have any other legal claim related to the community, or have observed the posting or distribution of any copyrighted materials (either your own copyrighted materials or those owned by a third party), please let us know via Contact Us.
  15. Ranking. Do not post material that is intended as Page Rank Bait.
  16. Terms of Use and Privacy. In addition to this Code of Conduct, your use of What's In, including, without limitation, the alert feature, is also subject to the T.J. Maxx website Terms of Use and Privacy Policy. This Code of Conduct applies to all Content submitted or posted to What's In. To the extent this Code of Conduct conflicts with the Terms of Use or the Privacy Policy posted on the T.J. Maxx website, this Code of Conduct shall apply to the use of and content posted or submitted to What's In, including without limitation, the alert feature. By using What's In, you are consenting to have your personal data transferred to and processed in the United States. TJX reserves the right to contact you should your comment be of a nature that we deem appropriate for a response from Customer Service.
  17. Amendments. This Code of Conduct may be changed or updated by TJX from time to time without prior notice. Continued use of or posting to What's In, including, without limitation, the alert feature, following such changes or updates shall constitute your acceptance of any new terms or conditions. You are responsible for regularly reviewing this Code of Conduct and we encourage you, therefore, to review it carefully whenever you post to or use What's In, including the alert feature.
  18. Termination. TJX may terminate your membership, delete your profile and any other Content that you have posted in What's In and/or prohibit you from using or accessing What's In for any reason, at any time in its sole discretion, with or without notice.
